Terms of Service

1. Acceptance of Terms

By accessing or using Extreme Vault (“the Service”), operated by Nedati Technologies Private Limited (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including individual users and organizations.

2. Description of Service

Extreme Vault is a cloud-based secrets management platform that uses zero-knowledge encryption. Secrets are encrypted on your device before being stored on our servers, ensuring that only you and your authorized team members can access your data.

3. Account Responsibilities

When you create an account, you agree to:

  • Keep your authentication credentials secure and confidential
  • Provide accurate and up-to-date account information
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to breach, circumvent, or test the vulnerability of the Service’s security measures without authorization
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to store, transmit, or distribute malicious software

5. Payment Terms

The Service is offered at $5 per month per organization, billed monthly. You may cancel your subscription at any time.

If you cancel, you will retain access to the Service until the end of your current billing period. Refunds are pro-rated for any unused time remaining in the current billing period.

We reserve the right to change our pricing with 30 days’ notice. Price changes will take effect at the start of your next billing cycle following the notice period.

6. Data Ownership and Security Responsibility

You retain all ownership rights to your data. We claim no intellectual property rights over the secrets or data you store using the Service. Due to our zero-knowledge architecture, we cannot access the contents of your encrypted data.

You are solely responsible for:

  • Safeguarding your device key, emergency kit, and passkey credentials
  • Controlling access to your organization and managing team member permissions appropriately
  • Maintaining the security of any devices used to access the Service
  • Determining whether the Service is appropriate for the type and sensitivity of secrets you choose to store
  • Maintaining your own backup of any critical data stored in the Service

If you lose your device key and emergency kit, your encrypted data cannot be recovered by anyone, including us. This is an inherent property of zero-knowledge encryption and is not a defect in the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR SECURITY.

Without limiting the foregoing, we do not warrant that: (a) the Service will be uninterrupted, error-free, or completely secure; (b) the Service will meet your specific security requirements; (c) any stored data will be immune from unauthorized access by third parties through means outside our control, including but not limited to compromised user devices, stolen credentials, social engineering, or vulnerabilities in third-party infrastructure; or (d) the cryptographic methods used will remain unbreakable indefinitely.

You acknowledge that no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security of your data.

8. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, infrastructure issues, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEDATI TECHNOLOGIES PRIVATE LIMITED AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss, exposure, or unauthorized disclosure of secrets, API keys, credentials, passwords, tokens, or any other data stored in the Service
  • Damages resulting from unauthorized access to your account or data, regardless of cause
  • Damages resulting from loss of your device key or emergency kit
  • Damages arising from the actions or omissions of third parties, including hosting providers, payment processors, or identity providers
  • Business interruption or downstream damages resulting from Service unavailability
  • Cost of procurement of substitute services

THIS LIMITATION APPLIES WHETHER THE DAMAGES ARISE FROM BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability for any and all claims arising from or related to the Service shall not exceed the lesser of: (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nedati Technologies Private Limited and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any data you store using the Service.

12. Termination

Either party may terminate this agreement at any time. You may close your account through the account settings or by contacting us.

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms of Service.

Upon account closure, your encrypted data will be permanently deleted from our servers within 30 days. This action is irreversible.

13. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. We will provide at least 30 days’ notice of material changes by email or by posting a notice on our website. Your continued use of the Service after the updated terms take effect constitutes acceptance of the revised terms.
